Are you familiar with the “indefinite work term conversion rule” (muki tenkan rule – 無期転換ルール)? Click here for more information!

Q1: Is a worker automatically converted to an indefinite employment contract after a total of five years?

A1: According to the law, an indefinite-term employment contract is formed when a worker whose contract has been in force for more than five years makes a “request”. Therefore, the worker himself must make the “request” in order to convert to an indefinite term employment contract.

Q2: Does the worker need to make the request in writing to convert to an indefinite term?

R2: If a worker applies to the company for an indefinite employment contract after the right to apply for indefinite conversion has been granted, an indefinite employment contract will be concluded (the company cannot refuse the application). Although the request can be made orally and is legally valid, it is advisable to make the request in writing to avoid later problems.

Q3: I applied for an indefinite term conversion, but the company told me that it “doesn’t allow permanent job changes”. Am I not allowed to change my indefinite contract?

A3: If a worker on a fixed-term contract with a total contract period of more than five years requests a change to an indefinite employment term before the expiry date of the current fixed-term contract, the employer (company) is deemed to have accepted the request and, at the time of the request, a permanent contract with a start date on the day following the day on which the fixed-term employment contract at the time of the request expires comes into effect.(Article 18, Paragraph 1, of the Employment Contract Act).

Therefore, the company cannot refuse to convert the contract into an open-ended contract.

The indefinite term conversion rule (muki tenkan rule – 無期転換ルール) means that when a fixed-term employment contract with the same company has been renewed for a total of more than five years, the contract can be converted into an employment contract with no fixed term (indefinite term employment contract) upon the employee’s request. (Article 18 of the Employment Contract Law: came into force on April 1, 2013).

In principle, everyone who has a fixed-term employment contract with a term of more than five years is eligible.

*Everyone has this right, regardless of the type of work, including “contract worker” (keiyaku shain), “part-time worker”, arubaito etc.

If a worker applies for an indefinite-term employment contract, the contract will become an indefinite-term employment contract from the day after the current fixed-term employment contract ends.

The number of foreigners working as permanent employees within Mie prefecture is on the rise. What kinds of companies do foreign employees work at? What kinds of initiatives are companies using to help foreign employees take on an active role?

This time, international students attending university in Mie prefecture, Liu Lexia and Cao Jing-Long covered the Nanbu Driving School in Ise city with their helper for the day, Takanoya Hisashi.

Nanbu Driving School has been No. 1 in the prefecture for 13 years for having the greatest number of new students each year in Mie. They call themselves “a praising academy,” where the instructors never scold the students. They also guarantee that the same instructor will be responsible for their student from entry to graduation, offering familiarity and a tailor-made experience for all students. Even after graduation, the school provides free “after service” for life so that former students can always brush up on safe driving.

「Interview ①　CEO Kato Koichi」

Q: What is special about Nanbu Driving School?

A: The motto of Nanbu Driving School is that praise encourages improvement. Our specialty is how our instructors genuinely praise the students and that makes driving fun for them.

Nanbu Driving School attracts Chinese students by offering lessons in Chinese. They hired Chinese employees and trained them to become instructors. They are also planning on changing their policies to allow their Chinese employees to take a long vacation back to China during the Chinese New Year.

「Interview ②　CEO　Kato Koichi」

Q: What kind of considerations have you made for foreign employees?

A: Chinese and other foreign employees are offered convenient working hours. Relationships in the workplace are also important. We want all our employees to get along well, so we encourage them to appreciate and praise each other too.

Q: Is it difficult to train foreign instructors?

A: The qualification exam is in Japanese, and these exams are difficult even for Japanese people. Our instructors studied really hard, probably twice as hard as a Japanese person would, in order to pass the exam.

The lessons in Chinese are very popular, and currently there are many applicants on the waiting list.

「Interview③　CEO　Kato Koichi」

Q: What are your plans for the Chinese driving lessons?

A: Currently, we have three people who can teach in Chinese. If possible I’d like to operate with five instructors. I would like the Chinese students on the waiting list to be able to enroll and get their licenses as soon as possible.

Jin Yu-Hong, a current driving instructor, and Zhao Yuan Quan, currently in the process of acquiring the qualifications, cheerfully talked about their work at Nanbu Driving School.

Q: What brought you to join the company?

A: I really wanted to join such a famous company. My favorite part of the job is how I can interact with other Chinese people. I’m Chinese myself and being able to teach driving to fellow Chinese people is another reason why I joined Nanbu.

Q: What is it like working here?

A: I think I made the right choice to join Nanbu. Work has been a lot of fun since I started here. And I was able to grow a lot by learning from my instructor.

「Interview Employee Zhao Yuan Quan」

Q: What brought you to join the company?

A: Before I came here I was already looking forward to coming to Japan. I love cars, so I decided to join the company.

Q: What is it like working here?

A: When foreigners come to Japan for the first time, I think they experience a lot of uneasiness and trouble, but I am lucky that there are a lot of friendly people at the company so whenever I am having trouble or if there are things I don’t know, they always help me. Because of his I’ve been able to work here with peace of mind. I’ve been so motivated after joining the company. I love Nanbu Driving School.

It seems what began as practice for praising students during lessons has also created a positive culture within the company where employees are motivated through mutual encouragement, regardless of nationality. And with other unique initiatives publicized in the media bringing students from across the country, employees are proud to be a part of this number 1 driving school in Mie.

The number of foreigners working as permanent employees within Mie prefecture is on the rise. What kinds of companies do foreign employees work at? What kinds of initiatives are companies using to help foreign employees take on an active role?

Kuwana City Medical Center

Kuwana City Medical Center just completed construction of a new ward in April 2018 and has been outfitted with the latest medical equipment. When all the wards are completed in December, there will be 400 beds in total.

Many residents of Kuwana in northern Mie are from foreign countries. Because of this, the hospital has had medical interpreters on hand since 2014. Medical interpreters not only help foreigners in terms of language but also facilitate the medical care process on site.

Carla Cardenas has been working at the medical center since they started offering medical interpretation there. She is able to quickly and accurately interpret the specialized Japanese used by doctors which is full of difficult lingo and terminology. We were able to interview Carla in one of the rooms specifically used for medical interpretation.

Medical Interpreter Carla Cardenas

It has been 22 years since I came to Japan as a “dekasegi” (a migrant worker of Japanese descent or their spouse) from Peru. Initially I could not speak Japanese. I only knew words like “sumo” and “kimono”. I gave birth to my first child in Japan and it was scary being hooked up to an IV without know what was going on. Still, in order for my child to be able to stay in a safe place like Japan, I began attending a Japanese language school. I think that by learning Japanese, many more possibilities have opened up for me. Working as a medical interpreter is one of them.

Currently, I interpret in Spanish and Portuguese most of the time but in special cases I will also interpret in English. Interpretation occurs at various stages such as during consultation, examination, admission, and surgery. We get calls from all around the hospital so it is busy every day.

Medical interpretation is more than just replacing words. Special care must be taken in order to improve communication between people of different cultures. For example, a Japanese doctor will confirm whether a pregnant woman intends to keep the child or not but this is a very shocking question for a Peruvian who has already assumed they will be keeping the child. I explain these cultural differences to both the patients and doctors beforehand so that they are mentally prepared.

I am treated very well by the other staff now but medical interpretation is a new line of work here and it took a lot of perseverance to build relationships with everyone. One time, a patient suddenly gave their doctor a Peruvian-style hug of gratitude. That doctor is usually very serious but they were actually delighted about the hug. The doctor and I were able to bond over this incident (laughs). Also, some patients hold themselves back in front of the doctor but they let it all out at the interpreter and that’s difficult to handle. Still, I’m glad to do this work and hearing the “thank you” from the patients makes the job feel worthwhile.

Japan Material Co., Ltd./JM Engineering Service Co., Ltd.

Japan Material Co., Ltd. offers services to support the operation of factories that manufacture semiconductors and liquid crystal. In just 20 years, with its high technical capabilities, Japan Material has expanded its business, made deals with world-famous semiconductor and liquid crystal manufacturers and trades in the First Section of the Tokyo Stock Exchange.

Engineers employed by its subsidiary, JM Engineering Service, work in “cleanrooms” at their clients’ factories. They work carefully with fragile products with no room for error. In order to help them succeed in their work, the engineers receive around 6 months of training at the head office’s Technical Training Center after joining the company. Those who are able to pass the exam at the end of training can go to work on site. Currently, seven engineers from Vietnam are in training, and 13 have already completed their training.

We spoke with two engineers from Vietnam who just finished the in-house training.

Engineer Truong Quoc Huy

I majored in mechatronics at a technical university in Vietnam. I was working at a Vietnamese company in America but I started going to a Japanese language school and joined this company in February this year. Now I am performing maintenance on semiconductor manufacturing equipment at the Toshiba Memory Corporation Yokkaichi Plant.

I’ve always liked robots, which is why I chose this job. It took me about 2 weeks to get used to the environment in Japan. I was having a hard time understanding Mie dialect in the beginning.

Engineer Dinh Van Thien

I graduated from a technical university in Vietnam, majoring in electrical and electronic engineering, and proceeded to enter a Japanese language school in Tokyo. I started working at this company from April this year. I wanted to join the company so that I could make good use of what I have studied at university and the company also provides good benefits. I am glad I joined the company because the job site is beautiful and my peers are very helpful.

Both employees displayed a strong sense of responsibility towards their work, and their reputation within the company is excellent. The company said it would like to hire more Vietnamese engineers like them in the future. To ensure the employees are able to live safely and securely in Japan, the company has been offering support by doing things like building dormitories. One of the philosophies of the company is that “employees are family members”. This is reflected in how the company values its employees regardless of their nationality. In turn, we were able to see how the employees also cherish the company and their coworkers.

Social Welfare Service Corporation Seizanrikai

Seizanrikai manages 50 nursing homes and other facilities for elderly people and disabled people around Yokkaichi, Kameyama and Nagoya. In 2009, they hired Nikkeijin (Japanese emigrants and their descendants) residing in Japan who were trying to find work as permanent employees. They have been developing their employees by supporting them in obtaining nursing care qualifications.

They currently have approximately 600 nursing staff. 10% of the staff are people from Brazil, the Philippines, Peru and Bolivia. Foreign students attending the adjoining vocational school which they operate are also working part-time for the company.

In addition to foreigners, the company also employs a diverse staff including older people, young men and people with disabilities. To ensure that everyone can participate, the company carefully divides tasks and clearly defines roles (such as laundry, delivery, night shift) when recruiting for the nursing facilities.

Nursing Care Staff Mori Kameri Yukie

I came to Japan from Brazil when I was two years old. With the goal of becoming economically independent, I quit my part-time job and started working at Seizanrikai.

I am currently working at a facility where 120 people with dementia live. Although meal assistance, bathing and toileting are my main tasks, I do not just do everything without asking. We tailor our support to the needs of the people we are caring for. The residents are our elders and respecting them is also central to our work.

Every day is different so I am still not used to the work but I am blessed to have excellent supervisors and colleagues who support me.

Life Counselor Zheng Shang-hai

In China I was working as a manga translator and doing interpretation. In 2000, I came to Japan, obtained a postdoctoral degree in welfare and found employment at Seizanrikai.

Currently, I offer counseling to the residents and their families at the elderly care facilities and coordinate communication with related organizations such as hospitals and the government. The work is difficult as I am consulted about personal problems that may not have a solution, but I enjoy being able to work with people. It is a job where I get to help others and that is very fulfilling. When you’re working, it’s important to want to keep making things better so I am also working towards improving things at the workplace.

The number of foreigners working as permanent employees within Mie prefecture is on the rise. What kinds of companies do foreign employees work at? What kinds of initiatives are companies using to help for foreign employees take on an active role?

This time, Wu KeXin and Nguyen Thi Xuan Dao, who are international university students in Mie, along with helper Ariyoshi Haruhisa conducted interviews at Asai Nursery, Inc. in Tsu City.

Asai Nursery strives to produce tomatoes with the best taste and highest yield in the world in order to meet the needs of the market and customers. They produce over 1,000 tons of mini tomatoes annually and have established an agricultural model with high profitability.

「Interview with Nomura Yoshiyuki, Production Manager」

Q: What is unique about Asai Nursery？

A: Asai Nursery mainly grows mini tomatoes but we do so using a cultivation method different than most growers in Japan. The company uses technologies originally from the Netherlands. For example, we use machines that can regulate the environment of the greenhouse. We also invite consultants from the Netherlands. We are operating while studying the latest technologies.

In that sense, I think you can see agriculture here that you will not find much of in Japan.

While adopting overseas technology, Asai Nursery is also promoting sales and technological development overseas. As this international exchange expands, the company has been recruiting young people from overseas.

「Interview with Nomura Yoshiyuki, Production Manager」

Q: Are you increasing the recruitment of foreign employees at your company?

A: One of our characteristics is that we often interact with people overseas. In that sense, we would like to hire some people who can speak English. We are planning to hire someone from Sweden around October. People from other countries are also welcome if they are interested.

Q: What kind of considerations do you give to the foreign employees?

A: There is no special treatment, because we are all members of the same team. You are treated the same whether you are Japanese or a foreigner. However, there are cases where someone might struggle with the Japanese language. I encourage them to not be shy and say whatever they want to say so that we can communicate with each other.

We also asked two foreign employees from China and Belgium on their thoughts regarding their work.

｢Interview with Wu Tingting, Research & Development｣

Q: Why did you join the company?

A: I met Mr. Yuichiro Asai, our current CEO & President, at Mie University during my doctoral program. I wanted to work with the latest in agriculture by introducing scientific theories in contemporary agriculture. I thought I could do just that if I joined Asai Nursery.

Q: What is something good about working at Asai Nursery?

A: It has a good working environment. Everyone is very open in communicating with me. Also, I’m very glad (I joined the company) because it is a workplace where I can make full use of my knowledge and be active globally.

Q: How is your relationship with other employees?

A: There really is no discrimination towards foreign people or Japanese people. It is easy to talk to everyone and we share many common interests and hobbies. We treat each other like friends, like siblings.

「Interview with Redouane Haider, Production Development」

Q: What is something good about working at Asai Nursery?

A: Everyone is motivated because they are enthusiastic about their work. That helps me to work hard together with them.

Q: How is your relationship with the other employees?

A: Communication is very important to me. I want to build good relationships by talking a lot with the others.

By incorporating state-of-the-art technology and practicing diversity management, Asai Nursery is a company which is changing the image of agriculture. Employees here are not just working at a farm; they are all participating in research. We can see that the motivation of each individual employee and the communication between the youthful staff is helping Asai Nursery to grow even further.

「Interview with Nomura Yoshiyuki, Production Manager」

A: I think there is a lot you have to watch out for when working at a Japanese company but there are also many companies where everyone can speak openly. In that sense, I would encourage you not to hesitate too much and try knocking on the door of a Japanese company.

The number of foreigners working as permanent employees within Mie prefecture is on the rise. What kinds of companies do foreign employees work at? What kinds of initiatives are companies using to help for foreign employees take on an active role?

This time, Wang Juan and Yan Yan, who are international university students in Mie, along with helpers Akamatsu Shigeru and Sugisaki Sae conducted interviews at Nakagawa Denso Co.,Ltd. in Matsusaka City.

Nakagawa Denso hired Vietnamese employees in 2017 and Korean employees in 2018. Vietnamese and Chinese technical intern trainees are also part of the company.

[Interview with President Kawanaka Eisuke ①]

Q: What are your thoughts about the employment of foreigners?

A: There are around 10 to 20 foreign employees working here. We do ask our foreign employees whether they would like to permanently reside in Japan or whether they want to return to their country in the future. However, the company is fine with either choice. We operate in various countries so I think it is good to have people from various countries in our main office in Japan.

We were taken on a tour of the factory at the head office. This factory is responsible not only for the development and design of molds for precision press manufacturing, but also the manufacture and mass production of metal and resin parts, and quality assurance.

They also manufacture parts that are indispensable for automobiles and household electric appliances such as “door closers”, which regulate the doors of automobiles so that they open and close automatically at a constant speed, and valves which control the flow of water in a washing machine.

Aside from Japan, there are also subsidiaries in Korea, China, Thailand and Vietnam.

[Interview with President Kawanaka Eisuke ②]

Q: What is the situation with the overseas subsidiaries?

A: We established the first subsidiary in Korea in 1972. Now, the president of that company is Korean, and the clients are Korean companies like LG Electronics and Samsung.

I would like to aim for the same both in China and in Southeast Asia. To that end, I think it’s a good idea for employees to come to Japan to train and learn more about Nakagawa. Hopefully there will be employees who can develop into executives.

[Interview with Executive Officer Kurosawa Sei’ichi]

Q: Is there anything that foreigners and Japanese people should be careful about when working together?

A: When making a product, there needs to be a procedure manual (a document detailing how to make the product). When we have foreign workers, we have to translate the Japanese manual into Chinese or Vietnamese so that they can learn from it. That’s the bare minimum required to work together I think.

Also, the job must always be done with a consistent method and attitude. In order to understand that, the employees must learn Japanese. The same goes for us: we also have to learn their language to make sure there are no misunderstandings.

In addition, Nakagawa Denso provides lifestyle support so that foreign employees can work comfortably.

[Interview with Ueda Katsunori, Deputy General Manager, Nakagawa Holdings Co., Ltd.]

Q: What kind of support do you have for foreign employees?

A: I am teaching Japanese to employees. They are aiming to pass the Japanese Language Proficiency Test.

This year, Mr. Lee Jin Kyu from Korea joined Nakagawa Denso as a permanent employee. He says his reason for joining the company was the strength of their technology.

[Interview with permanent employee Lee Jin Kyu]

A: After coming here and seeing the factory where they make the molds and meeting the staff, I decided I wanted to work here.

Q: Do you have any trouble communicating in the workplace?

A: There are many times when things aren’t taken the way I expected them to be.

But even with other Korean people, the same thing happens. In times like that, I have to make an effort to make things clear or the work will not progress right.
